Terms of Service

Your agreement with Qaly, Inc. for using Cardiogram. Last updated 1 August 2026.

1. Who we are, and what this agreement covers

Cardiogram is an iOS application made by Qaly, Inc. ("Qaly", "we", "us", "our"). These Terms of Service ("Terms") are an agreement between you and Qaly, Inc. governing your use of the Cardiogram app and the cardiogram.pro website (together, the "Service").

Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms.

2. Accepting these terms

Cardiogram has no account, no registration, and no password. By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the app is also subject to Apple's App Store terms, including the Licensed Application End User License Agreement, and to the terms governing your Apple Account and iCloud.

3. Who may use Cardiogram

You must be at least 18 years old to agree to these Terms. If you are under 18, you may use Cardiogram only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the Service.

Cardiogram is not intended for children under 13, and we do not knowingly collect their information.

4. Cardiogram is not a medical device

This is the most important section of these Terms. Please read it carefully.

Cardiogram reads heart-rate data your Apple Watch or iPhone has already recorded and presents it back to you — detecting rises, summarising trends, and letting you log symptoms, medications, and stand tests. That is all it does. It is a personal information-management and wellness tool.

Cardiogram does not, and is not intended to:

The thresholds the app uses — such as a 30 bpm rise, or 40 bpm for ages 12 to 19 — are widely cited reference points, not diagnostic criteria you can apply to yourself. Meeting them does not mean you have a condition, and not meeting them does not mean you are fine.

The heart-rate data itself comes from consumer hardware and Apple Health. It can be incomplete, delayed, or inaccurate, particularly during movement or poor sensor contact. Cardiogram's analysis is only as good as the underlying data, and we do not warrant that either is accurate.

Always consult a qualified healthcare professional about your symptoms and before making any health decision. Never disregard or delay seeking medical advice because of something you saw in Cardiogram. You are solely responsible for how you use the information the app shows you.

Any reports the app generates are a convenience for a conversation with your clinician. They are not a clinical record, and your clinician exercises their own judgement.

5. Your data

Cardiogram reads heart-rate and workout data from Apple Health with your permission, and stores what you log on your device and in your own private iCloud. We operate no servers and do not receive your health data. You can revoke Health access at any time in iOS Settings.

Because your data lives on your device and in your Apple Account, you are responsible for keeping it — including maintaining backups. Deleting the app, resetting your device, or removing its iCloud data deletes your entries, and we cannot recover them for you. The Privacy Policy explains all of this in detail.

6. Subscriptions, billing, and cancellation

Some features of Cardiogram require a paid subscription. Subscriptions are sold and billed through the Apple App Store, not by us.

Payment details are handled entirely by Apple. We never see your card number or billing address.

7. Your licence to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Cardiogram on Apple devices you own or control, for your own non-commercial use. We reserve all rights not expressly granted.

8. Intellectual property

The Service — including the app, the website, their content, design, and the Cardiogram and Qaly names and logos — is owned by Qaly, Inc. or its licensors and is protected by copyright, trademark, and other laws. These Terms grant you no rights in our trademarks.

The health data you record and the notes you write remain yours. We claim no ownership over them, and, as described in the Privacy Policy, we never receive them.

You may use content from the cardiogram.pro website — such as blog articles — for personal, non-commercial reference. Republishing, reselling, or redistributing it requires our written permission.

9. Feedback

If you send us ideas, suggestions, or feature requests, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose without obligation or compensation to you. Please do not send us anything you consider confidential.

10. Third-party services and links

Cardiogram depends on Apple services — HealthKit, iCloud, and the App Store — which are governed by Apple's own terms and privacy policy. Changes Apple makes to those services, or to iOS, may affect how the app works, and that is outside our control.

The Service may link to third-party websites. We do not control them and are not responsible for their content, policies, or practices.

11. Changes to the Service

We may add, change, suspend, or discontinue features of the Service at any time. If we discontinue a paid feature or the app entirely, we will give reasonable notice where we can. Because your data is stored on your own device and iCloud, you keep it regardless.

12. Termination

You may stop using the Service at any time by deleting the app, cancelling any subscription through Apple first if you do not want it to renew.

We may suspend or terminate your access if you materially breach these Terms, or where required by law. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, QALY, INC. DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT IT WILL DETECT ANY PARTICULAR EVENT OR DELIVER ANY PARTICULAR ALERT, OR THAT THE INFORMATION IT SHOWS IS ACCURATE OR COMPLETE. YOU ARE RESPONSIBLE FOR DETERMINING WHETHER THE SERVICE IS SUITABLE FOR YOUR PURPOSES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QALY, INC. AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US, OR PAID THROUGH THE APP STORE FOR CARDIOGRAM, IN THE TWELVE MONTHS BEFORE THE CLAIM, OR 100 USD.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU, AND OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

15. Indemnity

You agree to indemnify and hold Qaly, Inc. harmless from claims, losses, and reasonable legal costs arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right. This does not apply to the extent a claim arises from our own wrongdoing.

16. Apple

Apple is not a party to these Terms and has no responsibility for Cardiogram. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Qaly, Inc. — not Apple — is responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims, and for the investigation and defence of any third-party claim that the app infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of these Terms or the Service.

Before filing anything, please contact us at support@cardiogram.pro so we can try to resolve the problem informally. Most things can be sorted out this way.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection law, nothing in these Terms deprives you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts.

18. Export and sanctions compliance

You represent that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties.

19. General

If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If we translate these Terms, the English version prevails in a dispute.

20. Changes to these terms

We may update these Terms from time to time. We will change the "Last updated" date above, and for material changes we will give reasonable notice — at least 30 days where practical — in the app or on this site before they take effect. Continuing to use the Service after that means you accept the updated Terms. If you do not accept them, stop using the Service and cancel any subscription.
